Terms of Service

1. Acceptance of Terms

By downloading, installing, accessing, or using the DocScan mobile application ("App") provided by HAM Technologies ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

We reserve the right to modify these Terms at any time. Your continued use of the App following any changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

2. Use of Service

DocScan is a mobile application designed for scanning, editing, managing, and sharing documents. The App is provided for personal and business use, subject to these Terms.

You agree to:

• Use the App only for lawful purposes and in accordance with these Terms.
• Not use the App to scan, copy, or distribute documents that you do not have the legal right to reproduce.
• Not attempt to reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
• Not use the App in any manner that could damage, disable, overburden, or impair the App.
• Not use automated means to access or interact with the App.

Acceptable Use

You are solely responsible for ensuring that your use of the App complies with all applicable laws and regulations, including but not limited to copyright laws, privacy laws, and any laws governing the scanning and reproduction of official documents.

3. User Content

All documents, images, signatures, and other content you create, scan, or process using the App ("User Content") remain your property. We do not claim any ownership rights over your User Content.

• You are solely responsible for the legality, reliability, and appropriateness of your User Content.
• User Content is stored locally on your device. We do not access, view, or store your User Content on our servers.
• You are responsible for maintaining backups of your User Content. We are not liable for any loss of data.

4. Intellectual Property

The App, including its design, code, graphics, user interface, and all related intellectual property, is owned by HAM Technologies and is protected by applicable copyright, trademark, and other intellectual property laws.

• You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose.
• You may not copy, modify, distribute, sell, or lease any part of the App or its content.
• The DocScan name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of HAM Technologies.

5. Subscriptions and Purchases

Certain features of the App may require a paid subscription or one-time purchase. If you choose to make a purchase:

• All payments are processed through the respective app store (Apple App Store or Google Play Store) and are subject to their terms and conditions.
• Subscription fees are billed in advance on a recurring basis according to the subscription plan you select.
• You may cancel your subscription at any time through your app store account settings.
• Refunds are handled according to the policies of the respective app store.

6. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• We do not warrant the accuracy or reliability of any results obtained through use of the App, including OCR text extraction or document scanning.
• We do not warrant that the App will meet your specific requirements.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HAM TECHNOLOGIES, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, revenue, profits, or business opportunities.
• Damages arising from your use of or inability to use the App.
• Damages arising from any unauthorized access to or alteration of your data.
• Any other matter relating to the App.

Our total liability to you for any claims arising out of or related to these Terms or your use of the App shall not exceed the amount you have paid for the App in the twelve (12) months preceding the claim.

8. Indemnification

You agree to indemnify, defend, and hold harmless HAM Technologies and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the App or violation of these Terms.

9. Termination

We may terminate or suspend your access to the App at any time, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the App will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Changes to Terms

We reserve the right to modify or replace these Terms at any time at our sole discretion. If a revision is material, we will provide reasonable notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use the App after those revisions become effective, you agree to be bound by the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which HAM Technologies is established, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the App shall be resolved through good-faith negotiation. If a dispute cannot be resolved through negotiation, it shall be submitted to the competent courts of the applicable jurisdiction.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
